1. Acceptance of These Terms

These Terms of Service ("Terms") govern access to and use of the Synfonix platform, including the website, the organizer dashboard, web invitations and the associated messaging channels (together, "the Service"), operated from Mérida, Yucatán, Mexico.

By creating an account, accepting an invitation to the dashboard or using the Service, you confirm that you have read and accept these Terms and the Privacy Policy. If you do not agree, you must not use the Service.

If you accept these Terms on behalf of a company or agency, you represent that you have authority to bind it.

2. Description of the Service

Synfonix is a platform for wedding planners and event organizers that centralizes guest care. Depending on the plan, it includes:

•Attendance confirmation (RSVP) via WhatsApp, web invitation and other channels, with follow-up and reminders.
•An automated 24/7 concierge that answers guest questions using the information the organizer provides for their event.
•A dashboard with the guest list, imports, catering and allergies, stakeholder access, conversations and reports.
•Add-on features such as QR passes, door check-in and photo walls, when available.

Available features may vary by plan and may evolve over time; we will give notice of changes that substantially reduce what you contracted.

3. Accounts, Access and Security

Dashboard access is by invitation only. The account holder (planner or organizer) is responsible for the people they grant access to, such as the couple, relatives or their team, and for the permissions assigned to them.

You agree to provide accurate information, keep your access links and codes confidential, and notify us immediately of any unauthorized use.

We may revoke individual access or suspend an account to protect the security of the Service or of guests.

4. Acceptable Use and WhatsApp Messaging

Synfonix sends messages through the official WhatsApp Business API of Meta Platforms, Inc. ("Meta"). By using the Service, you also agree to comply with the WhatsApp Business Policy, the WhatsApp Commerce Policy and the applicable Meta Terms.

The organizer represents that every guest whose number is uploaded to the platform gave consent (opt-in) to receive event-related messages, and that this consent can be evidenced on request.

You must not use the Service to:

•a) Send unsolicited advertising, spam or messages unrelated to the event.
•b) Share content that is illegal, misleading, offensive, discriminatory or that infringes third-party rights.
•c) Upload numbers or data obtained without authorization, or impersonate another person or brand.
•d) Attempt to breach, overload or reverse-engineer the Service.

Any guest may stop receiving messages at any time by replying "STOP" or asking the organizer; we will honor that choice immediately. Breaching this section may result in account suspension.

5. AI-Powered Concierge

The concierge uses language models to answer guests based on the event information uploaded by the organizer (schedule, venue, dress code, gift registry, among others).

Automated answers may contain errors or omissions. The organizer is responsible for keeping the uploaded information accurate and up to date.

When the concierge cannot answer with certainty, or the guest asks for it, the conversation is handed off to a human on the organizer's team. Synfonix is not liable for decisions made solely on the basis of automated answers.

6. Plans, Payments and Billing

The Service is contracted under one of these modes, as agreed with each account:

•Monthly subscription with automatic recurring charges.
•Per event payment, settled before the event is activated.
•Direct payment to Synfonix by bank transfer or another agreed method.

Prices, usage limits (for example, number of guests, confirmations or conversations) and applicable taxes are disclosed before purchase. Meta messaging charges may be included or billed separately, depending on the plan.

Non-payment may result in suspension of the Service until the account is brought current. Unless the law provides otherwise or it is agreed in writing, payments for periods or events already started are non-refundable.

7. Personal Data

The processing of organizer and guest personal data is governed by our Privacy Policy, available at https://synfonix.net/en/privacy, which forms part of these Terms.

The organizer warrants having a legal basis and consent to share guests' data with Synfonix (name, phone number, dietary restrictions, etc.) and to use it solely to organize the event.

Anyone may exercise their ARCO rights or request deletion of their data following the procedure described in the Privacy Policy.

8. Intellectual Property and Content

The platform, its software, designs, templates, trademarks and logos belong to Synfonix or its licensors. These Terms grant you no rights over them other than using the Service while your account is active.

Content you upload (text, photos, guest lists, logos) remains yours. You grant us a limited license to host, process and display it solely to provide the Service.

You represent that you hold the necessary rights to the content you upload.

9. Availability and Third-Party Services

We strive to keep the Service continuously available, but we do not guarantee it will run uninterrupted or error-free. We may perform scheduled or urgent maintenance.

Part of the Service depends on third parties such as Meta (WhatsApp), cloud, payment and artificial intelligence providers. Synfonix is not responsible for outages, policy changes, blocks or fees imposed by those third parties.

10. Limitation of Liability

To the fullest extent permitted by law, Synfonix shall not be liable for indirect damages, lost profits, data loss or harm arising from the use of, or inability to use, the Service.

Synfonix's total liability to you is limited to the amount actually paid for the Service during the three months preceding the event giving rise to the claim.

Synfonix is not the organizer of the events and is not a party to the relationship between the organizer and its clients, vendors or guests.

11. Suspension and Termination

You may stop using the Service and request cancellation of your account at any time by writing to the contact email.

We may suspend or terminate an account for breach of these Terms, non-payment, risk to guests or at the request of Meta or an authority.

Upon termination, events are archived and you may request an export of your information within the following 30 days; afterwards, data is deleted or anonymized under the Privacy Policy, unless the law requires us to keep it.

12. Changes to These Terms

We may update these Terms to reflect changes in the law, the Service or the policies of integrated platforms such as Meta. We will publish the new version on this page with its updated date.

If the change is substantial, we will notify you by email or within the dashboard. Continuing to use the Service after the effective date means you accept the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the federal laws of the United Mexican States (Mexico).

For any dispute, the parties submit to the competent courts of Mérida, Yucatán, waiving any other jurisdiction that may apply, without prejudice to the rights granted to consumers under the Mexican Federal Consumer Protection Law.
